The LDPR is going to submit to the State Duma a draft resolution on the announcement of amnesty for persons who have committed administrative offenses in the field of traffic. The text of the initiative was published in his Telegram channel by one of the authors, the head of the Duma Committee on Labor, Social Policy and Veterans Affairs Yaroslav Nilov.

Almost all fines provided for in Chapter 12 of the Administrative Code “Administrative offenses in the field of traffic” may fall under amnesty.

An exception is proposed to be made for fines under Articles 12.8 and 12.26. Driving drunk, transferring control to a person who is intoxicated, and the driver’s failure to comply with the requirement to undergo a medical examination.

The authors believe that this will support citizens in the face of sanctions, as well as save their money.

In mid-April, the traffic police reported that they would not hold drivers accountable for minor violations of traffic rules. Employees of the department decided to focus on those who directly contribute to the commission of an accident, in particular drunk drivers.

An insignificant offense is an action or omission that formally contains signs of an administrative offense, but “taking into account the nature of the offense committed and the role of the offender, the amount of harm and the severity of the consequences that have occurred does not represent a significant violation of protected public legal relations,” the department explained.

Also, the traffic police noted that administrative offenses cannot include causing harm to legally protected interests in a state of extreme necessity. Cases when this danger could not be eliminated by other means and if the harm caused is less significant than its prevention, will not be considered violations, according to Article 2.7 of the Administrative Code.
