Who is subject to vaccination

According to the decree of the chief sanitary doctor of Moscow Elena Andreeva “On the implementation of preventive vaccinations for certain groups of citizens according to epidemic indicators”, people working in the field of trade and services must be vaccinated first of all. We are talking about public catering, retail outlets, beauty salons, fitness clubs, spa and massage salons, banks, transport, housing and utilities and energy, theaters, museums, libraries, MFC and civil services, as well as organizations subordinate to the authorities.

According to the calculations of the Moscow authorities, which were cited by the Vice-mayor for social Development Anastasia Rakova, employees of the categories defined by the decree in Moscow are 3.5-4 million. With the target rate of vaccinated at 60%, we are talking about just over 2 million people, but some of them are probably already vaccinated.

Who will control this process

Almost immediately after the decision of the chief sanitary doctor of Moscow on mandatory vaccination for workers in Moscow, the mayor of the capital, Sergei Sobyanin, said. From his decree, it follows that the Moscow Glavcontrol will monitor the implementation of the requirements of the authorities in Moscow. As the head of the Main Control Department of Moscow, Yevgeny Danchikov, later explained, control over the execution of the resolution begins on July 15 by the authorized executive authorities of Moscow together with Rospotrebnadzor.

From July 1, organizations and individual entrepreneurs will be required to provide electronic information through the personal account of legal entities on the portal mos.ru information about vaccination and the number of employees in these areas. Employers will be required to provide information about vaccinated employees with their SNILS, passport and mobile phone numbers, as well as an MHI policy, if available.

If a separate platform for monitoring vaccination is created, the Rospotrebnadzor, as the body responsible for the sanitary and epidemiological well-being of the population, should become the direct operator of such a platform, adds Alexander Panov, head of the Healthcare and Technology practice at BGP Litigation.

After the outbreak of the coronavirus pandemic in the spring of 2020, the Department of Information Technology (DIT) also through the portal mos.ru I launched a pass system: employers could issue passes for employees who cannot work from home, for this purpose it was necessary to fill out a special form on the website. The residents of the capital themselves could also issue passes in this way. In most other regions, the pass system created by the Ministry of Finance worked. The representative of the Ministry of Finance did not comment on whether the ministry will be engaged in monitoring the number of vaccinated citizens at the federal level.

Previously, there were data leaks from Moscow’s information systems. So, at the end of last year, the personal data of almost 100 thousand residents of Moscow who had been ill with coronavirus, including their full names, dates of birth, residential addresses, phone numbers and passport numbers, got into the Network. It is possible to refuse vaccination if there are antibodies

This option is being discussed, the interlocutors in the mayor’s office assured RBC. If such an opportunity arises, employees will need to provide relevant certificates, they said. It is not yet clear who will pay for the antibody tests-an employee, an organization, or the city authorities, if a decision is made, the sources told RBC.

According to the temporary recommendations of the Ministry of Health, if a person has antibodies to the virus, then vaccination is not indicated, said RBC associate professor of Infectious Diseases of the RUDN Sergey Voznesensky. At the same time, there is no mention of the titer or the minimum amount of antibodies in the decisions of the authorities, he said. However, a previously transmitted disease is not a contraindication to vaccination, so a person who has been ill can be vaccinated, the virologist added.

According to Anastasia Rakova, there should be enough vaccines in Moscow. “Already today, the deployed capacities allow us to increase the volume of daily vaccination by four times,” she noted.”At the same time, we are ready to quickly increase our capacity as the demand of the population increases.”

What can threaten the refusal of vaccination for legal entities

Moscow companies and individual entrepreneurs who do not comply with the order of the Mayor’s office to vaccinate employees against coronavirus will be punished with fines in the amount of 30 thousand to 1 million rubles, Danchikov said. For individual entrepreneurs, the fine will be from 30 thousand to 50 thousand rubles, for organizations-from 100 thousand to 300 thousand rubles. If the violations are revealed by a second check, the amount of the fine can be increased to 1 million rubles or the company’s work will be suspended for up to three months.

What is the threat to individuals for refusing vaccination

The quota of 60% of those vaccinated, established by Rospotrebnadzor, provides that some employees of companies may refuse to be vaccinated for medical reasons or other reasons. If an employee refuses to be vaccinated, the company can send him to work remotely or on unpaid leave until the restrictions are lifted by Rospotrebnadzor, says the source in the Moscow city hall.

In the resolution of the chief sanitary doctor, a clause is necessary that unvaccinated office employees can work from home, one of the retail market participants noted in a conversation with RBC.

The decree introduces an obligation for a legal entity, but not for an individual, if an individual refuses to be vaccinated, one of the retail market participants pointed out to RBC. “This means that, while remaining within the framework of the law, a legal entity does not have the ability to force an employee to undergo vaccination,” he explained.

How to vaccinate migrants

According to the law, only foreigners who have a temporary residence permit or a residence permit can get vaccinated, Panov says. Such a policy canget only foreigners who are “permanently or temporarily residing in Russia”. Who will pay for vaccination

What does the labor law say

According to the labor law lawyer Dmitry Kofanov, according to the law on the prevention of infectious diseases, every citizen has the right to refuse preventive vaccinations. Sanctions can only be applied to employees who are included in the list approved by government Decree No. 825, for example, in relation to doctors and teachers. They may be suspended from work and not paid their wages until they are vaccinated. If any measure or penalty is applied to the employee, the employee has the right to apply to the court, the expert noted.

At the same time, according to Ekaterina Tyagai, partner of the Pen & Paper bar association, although in fact the vaccination is voluntary, refusing it, the employee may “suffer adverse consequences”. In particular, such a person may be suspended from work without pay. For example, the Ministry of Labor in one of the letters indicated that”in the case of a decision of the chief state sanitary doctor of a subject of the Russian Federation or his deputies on the implementation of preventive vaccinations to citizens or their individual groups, citizens can refuse to vaccinate, but in this case they must be suspended from the work performed for the period of the epidemic.”

The issue of bringing to disciplinary responsibility employees who refused to vaccinate, controversial, says Tyagai. The employer may declare that the vaccination is the employee’s responsibility, since the lack of vaccination does not allow him to carry out work activities. “However, we believe that, given the general principle of voluntary vaccinations, disciplinary sanctions cannot be applied to an employee if they are refused,” she said.

How many vaccinated now
