A fixed-term employment contract in case of mobilization of an employee must be suspended, including if he is on probation. This was reported by the press service of the Ministry of Labor of Russia in Telegram.

“If an employee has signed an employment contract and is currently undergoing a probationary period, then in the case of a call for mobilization from September 21, 2022, his employment contract will also be suspended. It will be possible to return to work on the same terms», — noted in the department.

The employment contract of a mobilized employee who previously received a notice of reduction, but still continued to work, should also be suspended.

The Ministry of Labor stressed that in case of mobilization of an employee, the period of suspension of the employment contract will be included in his work experience.

The employee must bring his employer a copy of the summons from the military enlistment office. The employer, in his turn, issues an appropriate order for the suspension of the employment contract.

After that, the accounting department charges the employee a salary for all the days worked, but not yet paid, without waiting for the salary payment date.

“The employer must make all payments due to the employee at the moment, including wages, as well as other payments provided for by the employment contract, collective agreement, agreement of the parties to the social partnership,” the Ministry of Labor reminded.

On September 21, President Vladimir Putin announced a partial mobilization in Russia. Partial mobilization will affect citizens who have served and have military accounting specialties. 300 thousand people will be called up for service.

Some categories of IT specialists, employees of system-forming enterprises in the field of information and communications, as well as those working in organizations that ensure the stability of the payment system and financial market infrastructure will be exempt from the draft.

Military service will not attract those undergoing primary education in Russian universities in full-time and evening departments. Part-time students will be sent to service by the decision of the draft commission.
